ANALISIS PENYELESAIAN PERSELISIHAN HASIL PEMILIHAN KEPALA DESA
Abstract
Election of a headman is a process of implementing democracy in the village area. The implementation of the elections dispute often occurs. Article 37 paragraph (6) of Law Number 6 of 2014 concerning Villages states that if a dispute arises in the results of the village head election, the Regent/Mayor is obliged to resolve it within 30 (thirty) days. However, this provision does not specify in detail the stages of overcoming the dispute in the election. And the Mayor is not allowed to handle it themselves due to non-neutrality. Variation of disputes may occur due to the unclear arrangements and not idealized institutions in charge of resolving the disputes over the results of the elections. This research aims to analyze the stages of dispute resolution on the results of headman elections according to the applicable laws and regulations and which institution is the most ideal for resolving it. Method used is a normative juridical research method using the statutory approach, conceptual approach and case approach. Research legal materials were collected through primary, secondary and tertiary legal materials. The results of this research are: first, that the settlement of disputes over the results of headman elections is carried out by the Regent/Mayor assisted by the District Head Election Committee, the Village Head Election Committee and the BPD. The stages begin with the submission of objections by the candidate for village head, then settlement of disputes at the village level by the Headman Election Committee and the BPD, then at the district level by the Regency Level Village Head Election Committee and the final stage, namely conducted by the Regent/Mayor. Second, the most ideal institution to resolve the dispute over the results of headman elections is an ad hoc judiciary called the Village Head Election Result Dispute Resolution Court. The Headman Election Result Dispute Settlement Court is the first and last level judicial institution established by the Regional Government which is domiciled in the district/ city to resolve disputes over the results of the headman election, whose membership consists of 5 (five) members consisting of two Academics, the Legal Section of the Regional Secretariat District/City, BPD and Community Leaders.
