PERLINDUNGAN HAK MASYARAKAT ADAT TERHADAP PEMANFAATAN HUTAN DAN IMPLIKASI HUKUMNYA

Abstract


International law insists that the sovereignty of indigenous peoples in
natural resources management is a right that must be protected where the
state or the government is obliged to make it happen. The consideration of
law and philosophy in giving the indigenous peoples
protection in exploiting the natural resources because the indigenous
peoples have cultural values and local wisdom based on Sustainable
Development Principle. It means that the establihment of a certain forest
as a conservation area like the Lore Lindu National Park should not be
contrary and detrimental to the welfare of the people around that area as
the indigenous peoples were still exist from generation to generation and
have a close relationship in emotion with the forest.
